Back in August of 2016 the DEA told the public that within a couple of months kratom would become prohibited throughout the country. Scheduling it in the first class of drugs along with heroin, cocaine, LSD and others meant that this was a serious issue and eradication should be considered top priority. Being designated a Schedule 1 implies that kratom has a “high potential for abuse” and there is no evidence that use of the herb has any medical benefit.
Although it is claimed that the herb does not have medical benefit, many researchers state otherwise. Medical professionals claim that there have been large studies done on mice with results that support the possibility of addiction among users.

Originating in Thailand and other Southeast Asian countries, kratom has been commonplace for centuries. A pain reliever to some, an anti-anxiety medication to others, it is common among working people and those suffering with serious ailments. A cheaper and safer alternative to deadly opiates and other drugs and alcohol, the herb is seen as a healing tool that has been passed along for generations. In fact, entire communities have thrived off of the cultivation of this herb. Fathers have taught sons and those sons teach their own when they have them.
Although technically kratom is a psychoactive drug and it does bind to opioid receptors, it is quite a bit different than the normal drugs we hear about and often see the effects of first hand in many of our communities. One of the DEA's reasons for causing such a stir was that it would be virtually unregulated if looked at as a food substance rather than a controlled substance. Because of laws that were passed nearly two decades ago, the industry received a break from Congress and doesn't have to adhere to the same restrictions that could be applied for a pharmaceutical company. One of the differences is that as a neutraceutical company they are not allowed to make health claims but they can imply them quite heavily. They can also sell for human consumption. The only way to really get it taken from the market is for the FDA to prove it is harmful to the public. Whereas if kratom was considered a pharmaceutical drug it would have to be tested and proven safe before release to the public.

The DEA really has two choices in the matter. They can schedule kratom as an illegal drug and along with that would be all of the other details involved in any other drug deemed prohibited. The black market would continue to sell it, people will continue to buy it and also use substitutes. Certainly some users would turn back to powerful opiates such as prescription pain killers and perhaps one of the most popular drugs that are used before an attempt to get clean with kratom – heroin.
If it is going to be illegal it would automatically go to Schedule 1 unless the federal government proves there is some medical benefit of the substance. Unless the Controlled Substances Act was rewritten, this is the reality we find ourselves in. The new act could allow room for drugs that do have a slight potential of abuse but do offer some type of medical benefit. Drugs like kratom and marijuana could and should be dealt with differently than other drugs. Another alternative is that Congress could create a new class of drugs that would be sold behind the counter exclusively. This could mean it is controlled more and out of the reach of minors or others who are not familiar with the herb.
If the ban goes through the price on kratom will go up. Another problematic situation is the creation of counterfeit kratom. There will be much more incentive to do so as price rises because of scarcity and legal risks. Arrests will also follow as people are found in possession of the substance. That means more jail cells are taken, criminal records created or lengthened, courts are tied up with non-violent offenders and a plethora of other problems that will arise of creating a new form of criminality.

Now lets assume that we are going to go the other route. We are going to get it tested to make sure it is safe before we sell it. Well, the process there will probably involve some years and a few million dollars at least. Testing it in humans would be completely off of the table until the herb was administered to tons of mice over a couple of years at minimum. Once all of that were to pass you could be eligible to start phase 1 of human trials. Once that goes through and is complete you will have phase 2 which will be small-scale studies for various populations and specific indications. If all of that goes through and is completed to satisfaction you could gain approval for full phase 3 trials and the price tag on that alone would probably be at least a couple of million dollars. All of these tests could be done whether or not kratom was scheduled as an illegal drug. However the price would increase if it were scheduled as you would need DEA approval in order to even test it. In conclusion, you would need the FDA to decide whether or not the tests prove the drug to be effective to treat a particular disease or ailment among a specific population.

The next runner up would probably be Bali. This strain is popular because it usually can be attained a cheaper price, but some of the possible negative side effects are worth than the Borneo strain. Nausea can often follow high dosage levels. Bali is typically sedative as well but depending on the situation it may be a great choice for anxiety relief. Similar to Bali is Indo.
